Terms of Sales - Infinitydream

Preamble

Any order of a product on the site Infinitydream.com supposes the adhesion of the buyer to the following general conditions of sale.

The buyer can not validate an order on the site Infinitydream.com without declaring having read these general conditions of sale when establishing the order form.
The "click" on the box of declaration of knowledge of the terms of sale with value of electronic signature and is equivalent in the contract between buyer and seller to a handwritten signature in accordance with the law of March 13, 2000.
The order will then be confirmed by email to the address given by the buyer on the order form.

Some orders (large quantities, large amounts) may be subject to verification. Infinitydream reserves the right to request supporting documentation prior to shipment of order products.


Validation of orders

Orders placed on the site Infinitydream.com engage the customer upon receipt by our services of the order validation and its payment.
In case of payment in cash on delivery, orders placed on the site engage the customer upon receipt by our services of the order validation.


Availability

The offers presented on the Infinitydream.com website are only valid while stocks last.
Any product listed as "available" is a product in stock, available at any time, without delay.
Any order placed before 14:30 will be made available for delivery the same day or within a maximum of 2 days from the registration of it in case of high attendance.

If a stock error should occur or a product was unavailable at the time of the order because of our suppliers, the customer would be notified at the earliest with the possibility of canceling his order and get a refund of amount paid corresponding to the unavailable product or replacement with an equivalent product.


Price

LThe prices of the site are displayed TTC for a purchase from France or other countries of the EU.
For purchases from abroad (outside the EU) and DOM / TOM, prices are automatically reduced to HT when creating the customer account.
Ditto for the professionals of the EU having a valid intra-Community VAT number, the prices are automatically reduced to the HT at the end of the order (not subject to VAT).

Prices are displayed in Euros and are valid only on the date of sending the order form by the buyer, within the limits of available stocks.
Unless otherwise stated (promotions), our prices are valid for one day. They can thus be modified from one day to the next, without notice.
Prices shown are exclusive of delivery charges, which are indicated before the order is validated.


Payment methods

The following methods of payment are offered to the buyer during the validation of his order:
- For France: Credit card, check, European bank transfer and money order or cash
- For Europe, overseas territories and the rest of the world: credit card and European bank transfer

Infinitydream reserves the right to suspend and cancel an order in case of refusal of payment by the banking organizations or in case of non-payment.


Shipping methods

The following shipping methods are offered to the buyer during the validation of his order (BAL = mailbox):
- For France: Lettre suivie (BAL, delivered without signature), Colissimo suivi (BAL, delivered without signature), Colissimo recommandé (by hand, delivered against signature)
- For Europe: Export Suivi (BAL, delivered without signature), Postexport Europe (BAL, delivered without signature), Colissimo Inter (by hand, delivered against signature)
- For the DOM-TOM: Lettre suvie (BAL, delivered without signature), Colissimo suivi Outre-Mer (BAL, delivered without signature), Colissimo recommandé Outre-Mer (in hand, delivered against signature)
- For the rest of the world: Postexport Monde (BAL, delivered without signature), Colissimo Inter (in hand, delivered against signature)

Only shipping methods "delivered against signature" can claim full support by our services in the event of a delivery incident (damage during transport, loss or theft or non-presentation of the package).
However, for commercial purposes, Infinitydream reserves the right to study any complaint in the event of a delivery incident concerning the other types of sending so that the customer is never totally left after a clear fault of the carrier.
Finally, no claim for non-presentation of the package or spoliation can be taken into account in case of follow-up indicating an effective distribution in mailbox or an actual delivery against signature (La Poste is authentic).

Moreover, Infinitydream reserves the right to modify without notice the shipping method chosen by the customer when ordering if it is deemed inappropriate or superfluous as to the requirements of delivery and/or insurance package.


Delivery

Infinitydream is committed to making every effort to deliver the order in the shortest time, and this upon receipt of the order.

The delivery times indicated on the order form are given only as an indication and the possible delays do not give right to the buyer to cancel the sale, to refuse the goods or to claim any compensation.
Similarly shipping by Chronopost or DHL Express is not a guarantee of delivery for the next day. It is the customer's responsibility to ensure that the product availability conditions as well as the order processing and shipping schedules are compatible with same-day shipping for next-day delivery.
Infinitydream is released from its delivery obligation in any event fortuitous or force majeure. As an indication, total or partial strikes, floods, fires are cases of major force majeure.

Except exception, all our mailings in letter or parcel format have a tracking number which will be communicated to the customer as soon as the order is shipped.
It is up to the customer to follow the progress of the routing taking into account the delivery time indicated on the order form (D+2, D+3 to 8, etc.).
To do this, simply go to the order history, display the order in progress and then click on the tracking number corresponding to the shipment for the tracking page to appear.

In case of delay or absence of delivery past the expected delivery time, the customer must notify Infinitydream customer service as soon as possible by email or phone.
If no complaint was made by the customer within 7 days after this indicative delivery time, the delivery will be considered as effective and the goods delivered.

In case of delivery, any claim for nonconformity or missing must be sent within 2 days from the date of receipt of the order by the buyer.

The transfer of ownership of the products delivered or to be delivered is suspended until the full payment of the price by the customer without affecting the transfer of risks.


Transport

In case of delivery of the parcel against signature and/or by hand, it is up to the recipient (or receiver) to check the condition of the package and the contents of his order in the presence of the deliveryman and report immediately to it any abnormality. Transport is always at the risk of the recipient.
In case of delivery of the package in mailbox, it is the responsibility of the recipient to ensure the inviolability of it.
No further claims will be taken into account if the buyer has not complied with these procedures.

In addition, the responsibility of the sales site Infinitydream.com can not be blamed in case of theft, loss, destruction or damage occurred during the delivery.
In case of delivery incident, only Infinitydream is entitled to turn against the carrier to open an investigation and claim the extent of the harm within the contractual limits that bind them.
As a result of the investigation and the merits of the claim, our services will put in place the commercial and logistical solutions of circumstances so that the buyer can take possession as soon as possible of his order or obtain the replacement of his property.


Responsibilities

The customer is solely responsible for the choice and purchase of the product.
The total or partial inability to use the product especially in case of hardware or software incompatibility with the property of the buyer does not give rise to any compensation or refund.
Infinitydream can not be held responsible for any damage to the customer's property and the use of the products sold.


Estimate and repairs

Thanks to the command interface, the customer prepays the expenses inherent to the return of his material good and this for all types of repairs solicited.
If the material good received is not repairable or if the customer does not accept the quotation proposed for its repair, the costs of return postage necessary to the redirection of this one will remain chargeable to the customer.
The routing as the return of this material remains the sole responsibility of the customer.


Warranties

In accordance with articles L.217-7 to L.217-14 of the Consumer Code, the buyer benefits from a legal guarantee of conformity of 2 years on goods purchased new and 6 months on second-hand goods. This guarantee depends on the nature of the goods purchased. If the legal warranty is applicable, it will result either in the replacement of the goods, or its repair if this is technically and economically possible.
However, if a manufacturer's warranty is applicable as it stands, it will prevail over the legal warranty of conformity within the limit of its duration (1 or even 3 years depending on the type of product).
In addition, the client has a legal warranty against hidden defects for 2 years from the discovery of the defect (articles 1641 to 1649 of the Civil Code). It will be up to him to return the property acquired for the purpose of obtaining reimbursement or to keep the property and request a partial reimbursement if he so wishes.
In addition to these warranties, Infinitydream does not provide any other warranties except as specified in the product or contract form at the time of purchase.

In order for the warranty claim for the good concerned to be dealt with as soon as possible, any return may be reported in advance to Infinitydream Customer Service by email or mail by specifying the name of the product concerned and the nature of the failure encountered. A return number to be clearly mentioned on the parcel and the terms of sending will then be communicated to the buyer by email.
NB: Any return of defective product is the responsibility of the customer.


Right to retract

You have a period of 14 working days from the date of receipt of your order to return at your expense a product that does not suit you and to claim a full and immediate refund (Art. L121-20, L121-20-1).

A return number to mention visibly on your package and the terms of sending will then be sent to you by email.

Only products returned in their entirety and in their original packaging, intact and in perfect condition for resale will be accepted in return. Damaged products that have been attempted or installed and have their original packaging damaged will not be refunded or exchanged.
However, this right can not be exercised for a product that has undergone a transformation at the request of the customer (customization of a product, product made to measure, etc.) or for any service that has begun to be executed with the agreement of the customer. customer, the latter will remain at his exclusive expense and can not be the subject of any refund.
Regarding the reimbursement of shipping costs, the refund will be based on the least expensive basic transport product (Lettre suivie or Colissimo tracked/recommended) available at the time of order. In the case of a Chronopost or DHL Express shipment, the reimbursement will be the same on the basis of the least expensive basic transport product.


Abusive return of merchandise

In the event of an abusive or unjustified return of a product, the company Infinitydream reserves the right to charge the shipping costs inherent to the return of the product and to apply a flat rate of treatment ranging from 0€ to 30€ TTC according to the nature of the services provided by our services (unpacking / packaging the product, disassembling / reassembling the console, various tests, etc.).
Any abusive return will be subject to a written or verbal justification (by email or phone).
The customer will then be obliged to honor the assumption of these costs within a maximum period of 30 days or, failing that, to give up the goods for the benefit of our company.

NB: In order to avoid any unpleasant surprises regarding an inappropriate return, it is essential to contact the Customer Service of our company which will agree on the need to make a return based on your complaints.
However the return agreement is not worth recognition of a defect of the product.
Indeed, it is up to the customer to make sure of the merits of his request before requesting any return under penalty of registering in the context of the return of abuses of merchandise.


Disputes

Any order placed carries the buyer's adhesion, without any restriction, to Infinitydream's general conditions of sale. Any differences relating to the sale will be reconciled between the buyer and the seller and, failing that, will be subject to French law.
